Characteristic Definition
  1. Grade Status:
Graded
A graded position is assigned a salary grade within one of the salary grade ranges used at the University.
Ungraded
An ungraded position is designated as Grade 00 and does not fall within any of the salary grade ranges used at the University.
  1. Fair Labor Standards Act (FLSA) Status: a
Nonexempt
Non-exempt employees are subject to the minimum wage and overtime provisions of the Fair Labor Standards Act (FLSA). The University adheres to the District of Columbia's minimum wage requirements, regardless of where the non-exempt position is located. Currently, the District of Columbia's minimum wage is $6.60. Overtime pay is 1.5 times the employee's regular hourly rate for any work done in excess of 40 hours in 1 workweek. The FLSA defines workweek as a period of 168 contiguous hours during 7 consecutive 24-hour periods. The FLSA allows employers to set their own workweek as long as it consists of 7 consecutive 24-hour periods. The University workweek is Sunday (12:00 a.m.) through Saturday (11:59 p.m.). Supervisors maintain a record of actual hours worked for nonexempt employees. The supervisor must also set nonexempt employees' schedules within the workweek to minimize overtime and authorize overtime before the time is worked.
Exempt
Exempt employees, based on their duties and the responsibilities of the position, are not subject to the minimum wage or overtime provisions of the Fair Labor Standards Act (FLSA). They are paid on a salary basis for the duties they perform, not for the number of hours they work. It is essential that the supervisor ensure that an exempt employee actually performs the job functions set forth in the classification description. Incorrectly categorizing an employee as exempt from the FLSA minimum wage and overtime provisions when the employee does not perform duties that are within an exempt classification could lead to significant liability for the University.
  1. Work Schedule and Benefits Eligibility Status:
Regular Full-Time
Regular full-time positions are scheduled to work a 40 hours week;b established for a period in excess of six months and are eligible for applicable University benefits, as outlined in the University Benefits section.
Regular Part-Time
Regular part-time positions are scheduled to work at least 14 hours per week and no more than 32 hours per week, established for a least a fiscal year and are eligible for applicable University benefits, as outlined in the University Benefits section.
Limited Term
Limited term positions may be regular full-time or regular part-time, as outlined above. However, because of factors such as project or program length or funding conditions, the positions have a specific end date. The end date should be discussed with all candidates interviewed for the job and again with the final candidate when he or she is offered the job.
Temporary
A temporary position is a transitory position without University benefits. Cumulative employment in one or more temporary positions may not exceed 700 hours in a fiscal year. All temporary positions are ungraded and most are categorized as nonexempt.

a Nonexempt and exempt Fair Labor Standards Act (FLSA) designations are applied to positions based on criteria set by the FLSA. The criteria takes into account the duties and responsibilities of the position. The job title or grade alone does not determine whether a position is nonexempt or exempt. The Department of Compensation Administration assigns the nonexempt or exempt status of positions at the University based on the criteria specified in the FLSA.

b A small number of positions at the University have been grandfathered and permitted to remain as regular full-time with 35 hours per workweek. As these positions become vacant the workweek will be reviewed and may be revised to a 40 hour workweek to be consistent with other University regular full-time positions.
